An Act to Amend the Elections Act

 

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

 

1                   Section 13 of the Elections Act, chapter E-3 of the Revised Statutes, 1973, is repealed and the following is substituted:

 

13(1)            Every election shall be commenced by an order of the Lieutenant-Governor in Council.

 

13(2)            Nothing in this section affects the powers of the Lieutenant-Governor to dissolve the Legislative Assembly, by proclamation in Her Majesty's name, when the Lieutenant-Governor sees fit.

 

13(3)            Subject to the powers of the Lieutenant-Governor referred to in subsection (2),

 

(a)          a general election shall be held on Monday, October 18, 2010, and, thereafter,

 

(b)          general elections shall be held on the third Monday in October in the fourth calendar year following polling day in the most recent general election.

 

13(4)            An Order in Council referred to in subsection (1) shall

 

(a)          direct the issue of a writ of election for each electoral district in which an election is to take place,

 

(b)          fix the date on which the writs shall be issued and the date on which they shall be returnable in accordance with subsection (3), and

 

(c)           fix the date for the nomination of candidates, which shall be not more than twenty-one days nor less than eleven days after the date of the writs.
