An Act to Amend the
Members’ Conflict of Interest Act
Her Majesty, by and with the advice and
consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Section
12 of the Members’ Conflict of Interest Act, chapter M-7.01
of the Acts of New Brunswick, 1999, is amended
(a) by renumbering
the section as subsection 12(1);
(b) in subsection (1) by
repealing paragraph (a);
(c) by adding after subsection
(1) the following:
12(2) Except as otherwise provided in section 14, nothing in this Act
applies to a member of the Assembly by reason of the member receiving
a salary, financial assistance or other benefit from a registered
political party or a registered district association of which he or
she is a member.
2 Section
14 of the Act is amended
(a) by adding after subsection
(2) the following:
Payments from political party or district
association
14(2.1) A member of the Executive Council
shall not accept a salary, financial assistance or other benefit from
a registered political party or a registered district association.
14(2.2) Notwithstanding subsection (2.1), a member of the Executive
Council may be reimbursed by a registered political party or a registered
district association for reasonable expenses incurred by the member
on behalf of the registered political party or registered district
association.
(b) in subsection (4) by
striking out “subsection (1)” and substituting “subsections (1) and
(2.1)”.
3 Paragraph
18(4)(b) of the Act is amended by striking out “of which he
or she is a member”.
