An Act to Amend the
Jury Act
Her Majesty, by and with the advice
and consent of the Legislative Assembly of New Brunswick, enacts as
follows:
1 Subsection 13(2) of the Jury Act, chapter
J-3.1 of the Acts of New Brunswick, 1980, is repealed and the following
is substituted:
13(2) The persons to be summoned may be selected
(a) at random in accordance with the
regulations from the names of persons apparently resident in the judicial
district or a distinct part of it that are on a list provided for
in the regulations, or
(b) if a list provided for in the regulations
indicates the linguistic preference of the persons named on the list,
(i) in accordance with paragraph
(a),
(ii) at random in accordance with the
regulations from the names of persons on the list who are apparently
resident in the judicial district or a distinct part of it and whose
linguistic preference, according to the list, is the official language
in which the proceeding is to be conducted, or
(iii) partly in accordance with subparagraph
(ii) and partly in accordance with paragraph (a).
COMMENCEMENT
2 This
Act comes into force on a day to be fixed by proclamation.
EXPLANATORY NOTES
Section 1
The existing provision is as follows:
13(2) The persons to be summoned shall be selected at random in accordance
with the regulations from the names of persons apparently resident
in the judicial district or a distinct part of it that are on a list
provided for in the regulations.
