An Act to Amend the Fish and Wildlife Act
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Subsection 39.1(2) of the Fish and Wildlife Act, chapter F-14.1 of the Acts of New Brunswick, 1980, is repealed and the following is substituted:
39.1(2) Subsection (1) does not apply to
(a)  a conservation officer acting under section 27,
(b)  a person acting under and in accordance with subsection 34(4),
(c)  a person acting under and in accordance with written authorization given under subsection 34(7), or
(d)  a holder of a proper licence who hunts wildlife on a weekly day of rest during the period beginning on October 28 and ending on November 17, inclusive.
2 Section 42 of the Act is amended
(a)  in subsection (1) in the portion preceding paragraph (a) by striking out “subsection (2), (3) or (4)” and substituting “subsection (2), (3), (3.1) or (4)”;
(b)  by adding after subsection (3) the following:
42(3.1) Where a person is the holder of a proper licence, the person may transport or have in his or her possession a firearm in a resort of wildlife on a weekly day of rest during the period beginning on October 28 and ending on November 17, inclusive.
EXPLANATORY NOTES
Section 1
The existing provision is as follows:
39.1(2) Subsection (1) does not apply to
(a)  a conservation officer acting under subsection 27,
(b)  a person acting under and in accordance with subsection 34(4), or
(c)  a person acting under and in accordance with written authorization given under subsection 34(7).
Section 2
(a)  Consequential amendment.
