Statute Law Amendment
Act 2008
Her Majesty, by and with the advice
and consent of the Legislative Assembly of New Brunswick, enacts as
follows:
Ambulance Services
Act
1(1) Section 1 of the French version of the
Ambulance Services Act, chapter A-7.3 of the Acts of New Brunswick,
1990, is amended
(a) by repealing
the definition « malade »;
(b) in the
definition « ambulance » by striking out “malades”
and substituting “patients”;
(c) in the
definition « ambulance aérienne » by striking
out “malades” and substituting “patients”;
(d) in the
definition « exploiter » by striking out “malades”
and substituting “patients”;
(e) by adding
the following definition in alphabetical order:
« patient » désigne la personne
qui nécessite ou peut nécessiter des soins médicaux; (patient)

14(2)b) of the French version of the Act is amended by striking out “malades”
and substituting “patients”.
1(3) Paragraph
15c) of the French version of the Act is amended by striking out “malades”
and substituting “patients”.
1(4) Paragraph
22a) of the French version of the Act is amended by striking out “malades”
wherever it appears and substituting “patients”.
1(5) Section
24 of the French version of the Act is repealed and the following
is substituted:
24 Une personne employée à la fourniture de services d’ambulance
ne peut divulguer des renseignements se rapportant à la situation
personnelle d’un patient, à moins que le patient ne l’exige
ou que le commandent son intérêt ou les soins des patients
en général.
1(6) Section
27 of the French version of the Act is amended by striking out “malade”
wherever it appears and substituting “patient”.
Class Proceedings Act
2 Paragraph
3(4)a) of the French version of the Class Proceedings Act, chapter
C-5.15 of the Acts of New Brunswick, 2006, is amended in the portion
preceding subparagraph (i) by striking out “d’avis de
requête” and substituting “d’avis de poursuite”.
Hospital
Act
3(1) Section 1 of the French version of the
Hospital Act, chapter H-6.1 of the Acts of New Brunswick, 1992, is
amended
(a) by striking
out the definition « malade »;
(b) in the
definition « admission » by striking out “malade”
and substituting “patient”;
(c) by adding
the following definition in alphabetical order:
« patient » désigne la personne
qui reçoit d’une régie régionale de la santé
des services hospitaliers; (patient)
3(2) Section
20 of the French version of the Act is amended
(a) in
subsection (1) by striking out “malade” and substituting “patient”;
(b) in subsection
(2)
(i) in the portion
preceding paragraph a) by striking out “malade” and substituting “patient”;
(ii) in paragraph
d) by striking out “malade” and substituting “patient”;
(c) in subsection

21 of the French version of the Act is amended by striking out “malade”
wherever it appears and substituting “patient”.

24(1) of the French version of the Act is amended by striking out “malade”
and substituting “patient”.

35(1) of the French version of the Act is amended
(a) in
paragraph q) by striking out “malades” wherever it appears
and substituting “patients”;
(b) in paragraph
r) by striking out “malades” and substituting “patients”;
(c) in paragraph
s) by striking out “malades” and substituting “patients”.
Mining Act
4 Subsection
19(4) of the French version of the Mining Act, chapter M-14.1 of the
Acts of New Brunswick, 1985, is amended by striking out “paragraphe
(3)” and substituting “paragraphe (2)”.
New Brunswick Investment
Management Corporation Act
5 Section 6 of the New Brunswick Investment
Management Corporation Act, chapter N-6.01 of the Acts of New Brunswick,
1994, is repealed and the following is substituted:
6 The board of directors of the Corporation shall consist of the following
members:
(a) the President of the Corporation;
(b) the Deputy Minister of Finance,
who shall be a non-voting member;
(c) the Vice-President of Finance of
the New Brunswick Power Holding Corporation; and
(d) at least six other members who shall
be appointed by the Lieutenant-Governor in Council,
(i) one of whom shall be the dean of a
faculty of business administration or similar faculty, or the person
who holds the equivalent position, at a university in the Province,
(ii) one of whom shall be a member
of the public service superannuation plan in respect of which the
Corporation acts as trustee of the pension fund referred to in section 27 of the Public Service Superannuation Act,
(iii) one of whom shall be a member of
the teachers’ pension plan in respect of which the Corporation
acts as trustee of the Teachers’ Pension Fund referred to in
section 26 of the Teachers’ Pension Act, and
(iv) three of whom shall not be
members of a pension plan described in subparagraph (ii) or (iii),
but who shall, in the opinion of the Lieutenant-Governor in Council,
have knowledge, experience and expertise relevant to the business
and affairs of the Corporation.
Off-Road Vehicle Act
6(1) Sections
24.1 and 24.2 of the Off-Road Vehicle Act, chapter O-1.5 of the Acts
of New Brunswick, 1985, as enacted by section 6 of An Act to Amend
the Off-Road Vehicle Act, chapter 53 of the Acts of New Brunswick,
2007, are renumbered as sections 24.01 and 24.02 respectively.
6(2) Subsection 24.02(1) of the Act is amended
by striking out “section 24.1” and substituting “section 24.01”.
Ombudsman
Act
7 Subsection
18(2) of the Ombudsman Act, chapter O-5 of the Revised Statutes, 1973,
is amended
(a) in paragraph
(a) by striking out “subsection (1)” and substituting “subsection 19.1(2)”;
(b) in paragraph
(c) by striking out “subsection (1)” and substituting “subsection 19.1(2)”.
Provincial
Offences Procedure Act
8(1) Subsection
14(5) of the French version of the Provincial Offences Procedure Act,
chapter P-22.1 of the Acts of New Brunswick, 1987, is repealed and
the following is substituted:
14(5) Le montant de la pénalité prévue correspond à
la somme des montants suivants :
a) l’amende minimale fixée
pour l’infraction alléguée;
b) toute autre amende ou pénalité
pécuniaire exigée en vertu d’une loi;
c) le montant supplémentaire payable
en application de la Loi sur les
services aux victimes, s’il y a lieu;
d) les frais d’administration
réglementaires.
8(2) Paragraph
46(1)c.1) of the French version of the Act is repealed and the following
is substituted:
c.1) si les procédures ont été
commencées par le dépôt d’un avis de poursuite
et qu’une amende est infligée, ajouter les frais d’administration
prévus au paragraphe (1.1) à la somme de l’amende
et du montant supplémentaire, s’il y a lieu, payable en

8(3) Subsection
47(2) of the French version of the Act is repealed and the following
is substituted:
47(2) La somme de l’amende, de tout montant supplémentaire
exigé en vertu de la Loi sur
les services aux victimes et de tous les frais d’administration
payables en vertu du paragraphe 46(1.1) peut être inscrite au procès-verbal de la décision
en un seul montant représentant également l’amende
infligée, peu importe que la somme dépasse l’amende

8(4) Section
80.1 of the Act is repealed and the following is substituted:
80.1 For the purposes of the provisions of this
Act relating to the payment and enforcement of fines, any reference
to a fine shall be deemed to be a reference to the combined total
of a fine imposed under this Act, any surcharge under the Victims Services Act and any administrative
fee under subsection 46(1.1).
8(5) Section
115 of the French version of the Act is amended
(a) in
subsection (1) by striking out “Toutes pénalités prévues
payables en vertu du paragraphe 46(1.1) et toute amendes” and
substituting “Les frais
administratifs payables en vertu du paragraphe 46(1.1) et les amendes”;
(b) in subsection
(3) by striking out “un arrêté de celle-ci garde les
pénalités prévues” and substituting “un de ses arrêtés conserve
la pénalité”.
Regional Health Authorities
Act
9(1) Section 1 of the French version of the
Regional Health Authorities Act, chapter R-5.05 of the Acts of New
Brunswick, 2002, is amended
(a) by striking
out the definition « malade »;
(b) in the
definition « services de santé publique »
by striking out “malades” and substituting “patients”;
(c) in the
definition « services de toxicomanie » by striking
out “malade” and substituting “patient”;
(d) in the
definition « services extra-muraux » by striking
out “malade” and substituting “patient”;
(e) by adding
the following definition in alphabetical order:
« patient » désigne la personne
qui reçoit d’une régie régionale de la santé
des services de santé; (patient)
9(2) Section
9 of the French version of the Act is amended
(a) in paragraph
d) by striking out “malades” and substituting “patients”;
