An Act to Amend the
Workplace Health, Safety and Compensation Commission Act
Her Majesty, by and with the advice and
consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Section
8 of the Workplace Health, Safety and Compensation Commission Act,
chapter W-14 of the Acts of New Brunswick, 1994, is amended
(a) in subsection
(1)
(i) by adding after
paragraph (a) the following:
(a.1) a Vice-Chairperson of the board
of directors who, in the opinion of the Lieutenant-Governor in Council,
is not representative of either workers or employers,
(ii) in
paragraph (b) by striking out “three” and substituting “four”;
(iii) in paragraph
(c) by striking out “three” and substituting “four”;
(iv) by repealing
paragraph (d).
(b) in subsection
(4) by striking out “as representative of workers, employers
or the general public” and substituting “as representative of workers or
employers”.
2 Section 9 of the Act is amended
(a) by adding
after subsection (1) the following:
9(1.1) Notwithstanding subsection (2), the first appointment under
paragraph 8(1)(a.1) may be for a
term not exceeding four years.
(b) by repealing
subsection (2) and substituting the following:
9(2) The term of office of a member of the board of directors, other
than the Chairperson of the board of directors, the President and
Chief Executive Officer and the Chairperson of the Appeals Tribunal,
is for four years.
(c) by repealing
subsection (3) and substituting the following:
9(3) The Vice-Chairperson of the board of directors shall act as Chairperson
in the absence or inability to act of the Chairperson of the board
of directors or in the case of a vacancy.
(d) by repealing
subsection (4);
(e) by repealing
subsection (5) and substituting the following:
9(5) Subject to subsection (7.1), members referred to in paragraphs 8(1)(a.1), (b) and (c) are eligible for
reappointment for one additional term.
(f) by adding
after subsection (7) the following:
9(7.1) An appointment under subsection (7) does not make a person
ineligible to serve two additional terms as a member of the board
of directors.
(g) in subsection
(10) by striking out “such Vice-Chairperson entitled to act
in place of the Chairperson of the board of directors” and substituting “the Vice-Chairperson”.
3 On the commencement of this section,
(a) the appointment
of the member of the board of directors who was appointed under paragraph
8(1)(d) of the Workplace Health, Safety and Compensation Commission
Act is revoked, and
(b) a member
who holds the office of Vice-Chairperson pursuant to subsection 9(3)
of the Workplace Health, Safety and Compensation Commission Act immediately
before the commencement of this section shall not act as a Vice-Chairperson
of the board of directors, unless appointed under paragraph 8(1)(a.1)
of the Workplace Health, Safety and Compensation Commission Act.
4 This Act comes into force on a day to be
fixed by proclamation.
