An Act to Amend the
Tobacco Sales Act
Her Majesty, by and with the advice and
consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Section
1 of the Tobacco Sales Act, chapter T-6.1 of the Acts of New Brunswick,
1993, is amended by adding the following definitions in alphabetical
order:
“cigarillo” includes
a tobacco product that («cigarillo»)
(a) is sold as a cigarillo,
(b) is in the form of a roll or tube,
has a wrapper that contains natural or constituted leaf tobacco and
(i) weighs less than 1.4 grams or such
other weight as may be prescribed by regulation, or
(ii) has a cellulose, acetate or other type of filter, or
(c) is prescribed by regulation to be
a cigarillo;
“flavoured cigarillo”
includes a cigarillo that is represented as being flavoured, that
contains a flavouring agent or that is presented by its packaging,
by advertisement or otherwise as being flavoured; («cigarillo aromatisé»)
“flavoured
tobacco product” includes a tobacco product that is represented
as being flavoured, that contains a flavouring agent or that is presented
by its packaging, by advertisement or otherwise as being flavoured,
but does not include a flavoured cigarillo; («produit du tabac aromatisé»)
2 Section
4 of the Act is amended
(a) by renumbering
the section as subsection 4(1);
(b) by adding
after subsection (1) the following:
4(2) Notwithstanding subsection (1), no person shall sell or offer
for sale any cigarillos unless the cigarillos are enclosed in a package
that contains a minimum of 20 cigarillos.
3 The
Act is amended by adding after section 4 the following:
Flavoured tobacco products
4.1(1) No person shall sell or offer for sale a flavoured cigarillo
unless the flavoured cigarillo has been prescribed by regulation.
4.1(2) No person shall sell or offer for sale a flavoured tobacco product
unless the flavoured tobacco product has been prescribed by regulation.
4 Section
12 of the Act is amended by adding after paragraph (b) the following:
(b.1) prescribing a maximum weight for
the purpose of subparagraph (b)(i) of the definition “cigarillo”;
(b.2) prescribing tobacco products for
the purpose of the definition “cigarillo”;
(b.3) defining “flavouring agent”
for the purpose of the definitions “flavoured cigarillo”
and “flavoured tobacco product”;
(b.4) prescribing permitted flavoured
cigarillos for the purpose of subsection 4.1(1);
(b.5) prescribing permitted flavoured
tobacco products for the purpose of subsection 4.1(2);
5 Schedule
A of the Act is amended by striking out:
and substituting
the following:

6 This Act or any provision of it comes into
force on a day or days to be fixed by proclamation.
