An Act Respecting Expenditure Restraint
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
Executive Council Act
Amendment to the Executive Council Act
1 Subsection 6.1(2) of the Executive Council Act, chapter E-12 of the Revised Statutes, 1973, is amended in the portion preceding paragraph (a) by striking out “2009” and substituting “2011”.
Legislative Assembly Act
Amendments to the Legislative Assembly Act
2(1) Section 25 of the Legislative Assembly Act, chapter L-3 of the Revised Statutes, 1973, is amended
(a)  in subsection (1.1) in the portion preceding paragraph (a) by striking out “2009” and substituting “2011”;
(b)  by adding after subsection (2) the following:
25(2.001) Despite subsection (2), for the twelve month period commencing on January 1, 2009, and for the twelve month period commencing on January 1, 2010, the amount of the indemnity payable to each member of the Legislative Assembly holding the position of Whip of a recognized party shall be the same as the amount established under subsection (2) for the twelve month period commencing on April 1, 2008, and such indemnity shall be deemed to be the indemnity authorized to be paid under subsection (2).
(c)  by adding after subsection (2.01) the following:
25(2.02) Despite subsection (2.01), for the twelve month period commencing on January 1, 2009, and for the twelve month period commencing on January 1, 2010, the amount of the indemnity that may be paid to each member of the Legislative Assembly holding the position of House Leader or Caucus Chair of a recognized party shall be the same as the amount established under subsection (2.01) for the twelve month period commencing on April 1, 2008, and such indemnity shall be deemed to be the indemnity authorized to be paid under subsection (2.01).
2(2) Section 37 of the Act is amended by adding after subsection (2) the following:
37(3) Despite subsection 25(1.1) as it read immediately before April 1, 2008, for the twelve month period commencing on January 1, 2009, and for the twelve month period commencing on January 1, 2010, the amount of the annual indemnity payable to a member of the Legislative Assembly who made an election under subsection (1) shall be the same as the amount payable under that subsection 25(1.1) for the twelve month period commencing on January 1, 2008, and such annual indemnity shall be deemed to be the annual indemnity authorized to be paid under that subsection 25(1.1).
COMMENCEMENT
3 This Act shall be deemed to have come into force on January 1, 2009.
