An Act to Amend the Workers’ Compensation Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 Section 38.11 of the Workers’ Compensation Act, chapter W-13 of the Revised Statutes, 1973, is amended

(a)  in subsection (4) by striking out “(7) or (8)” and substituting “(7), (8) or (8.1)”;

(b)  by adding after subsection (8) the following:

38.11(8.1) Where a firefighter as defined in the Firefighters’ Compensation Act or a police officer as defined in the Police Act is injured while responding to an emergency, the Commission shall pay compensation in respect of the period of time referred to in subsection (3).

CONSEQUENTIAL AMENDMENT

Firefighters’ Compensation Act

2(1) The heading “Three day deductible” preceding section 11 of the Firefighters’ Compensation Act, chapter F-12.5 of the Acts of New Brunswick, 2009, is repealed.

2(2) Section 11 of the Act is repealed.
