An Act to Authorize The City of Saint John to Set Aside a Portion of Tucker Park for Street Purposes
WHEREAS The City of Saint John prays that it be enacted as hereinafter set forth;
AND WHEREAS it is desirable that the trust relating to Tucker Park be enlarged to permit that a portion thereof be used for the purposes of a public street;
THEREFORE, Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Notwithstanding anything contained in the Will of the late Joseph J. Tucker or in any other document, conveyance or Act, The City of Saint John shall be deemed to have been and is hereby authorized to set aside a parcel of land comprising 675 square meters, being a portion of the lands known as Tucker Park devised by the late Joseph J. Tucker to The City of Saint John, and designated “Arlington Crescent (Public Street)” on a subdivision plan filed in the Saint John County Registry Office on the 30th day of April, 2009 as Number 27093831 for the purposes of a public street.
