An Act Respecting Health
Services and Language
Her Majesty, by and with the advice and
consent of the Legislative Assembly of New Brunswick, enacts as follows:
Regional Health Authorities
Act
1(1) The
Regional Health Authorities Act, chapter R-5.05 of the Acts of New
Brunswick, 2002, is amended by adding after section 13 the following:
Designation of university hospital centres
13.1 Upon
application by a regional health authority, the Minister may designate
hospitals as university hospital centres or affiliated university
hospital centres.
1(2) The Act is amended by adding
after section 18 the following:
Language and health services
18.1(1)
Regional Health Authority A/Régie régionale de la santé
A shall operate in French and Regional Health Authority B/Régie
régionale de la santé B shall operate in English.
18.1(2)
Notwithstanding subsection (1), a regional health authority shall
(a) respect the language of daily operations
of the facilities under its responsibility, and
(b) provide health services to members of
the public in the official language of their choice through the regional
health authority’s network of health establishments, facilities
and programs.
18.1(3)
Each regional heath authority has the responsibility to improve the
delivery of health services in the French language.
1(3) Section 19 of the Act is amended
(a) in paragraph (1)(a) by striking
out “shall be reflective of the linguistic community served
and”;
(b) by repealing subsection (8);
(c) by repealing subsection (9) and
substituting the following:
19(9)
A board of directors of a regional health authority and its members
shall conduct their affairs in the language of operation of the regional
health authority.

3 of the New Brunswick Health Council Act, chapter N-5.105 of the
Acts of New Brunswick, 2008, is amended
(a) in paragraph (h) of the English
version by striking out “and” at the end of the paragraph;
(b) by adding after paragraph (h)
the following:
(h.1) to take into account the particular needs
of the two official linguistic communities in the exercise of the
activities referred to in paragraphs (a)
to (h); and
