An Act Respecting the Revised
Statutes, 2011
Her Majesty, by and with the advice and
consent of the Legislative Assembly of New Brunswick, enacts as follows:
Clean Water Act
1 Subsection
12(3) of the Clean Water Act, chapter C-6.1 of the Acts of New Brunswick,
1989, is amended
(a) in paragraph (a) by striking
out “section 25” and substituting “section
22”;
(b) in paragraph (b) by striking
out “subsection 28(1)” and substituting “subsection
25(1)”;
(c) in paragraph (c) by striking
out “subsection 30.1(2)” and substituting “subsection
30(2)”.
Clean Environment Act
2 Subsection
5.3(3) of the Clean Environment Act, chapter C-6 of the Revised Statutes,
1973, is amended
(a) in paragraph (a) by striking
out “section 25” and substituting “section
22”;
(b) in paragraph (b) by striking
out “subsection 28(1)” and substituting “subsection
25(1)”;
(c) in paragraph (c) by striking

(a) in subsection (1) by striking

1973, is amended by striking out “the chapter outlines”
and substituting “the

Official Languages
Act
11 Section
1 of the Official Languages Act, chapter O-0.5 of the Acts of New
Brunswick, 2002, is amended in the definition “department”
by striking out “subsection 1(1)” and substituting “section 1”.
Medical Services Payment
Act
12 Section
6 of the Medical Services Payment Act, chapter M-7 of the Revised
Statutes, 1973, is amended by striking out “section 51”
and substituting “section
44”.
Members Superannuation
Act
13 Subsection
1(1) of the Members Superannuation Act, chapter M-8 of the Revised
Statutes, 1973, is amended in the definition “salary”
(a) in paragraph (a) by striking
out “subsection 5(1)” and substituting “subsection
6(1)”;
(b) by repealing paragraph (c) and
substituting the following:
(c) the salary authorized to be paid under
subsection 6(3) of the Executive
Council Act, as adjusted from time to time under that Act,
to a member of the Executive Council not in receipt of a salary under
subsection 6(1) or (2) of that Act, and
Members’ Pension
Act
14 Subsection
1(1) of the Members’ Pension Act, chapter M-7.1 of the Acts
of New Brunswick, 1993, is amended in the definition “salary”
(a) in paragraph (a) by striking
out “subsection 5(1)” and substituting “subsection
6(1)”;
(b) by repealing paragraph (c) and
substituting the following:
(c) the salary authorized to be paid under
subsection 6(3) of the Executive
Council Act, as adjusted from time to time under that Act,
to a member of the Executive Council not in receipt of a salary under
subsection 6(1) or (2) of that Act, and
Fish and Wildlife Act
15(1) Subsection 34(1) of the Fish
and Wildlife Act, chapter F-14.1 of the Acts of New Brunswick, 1980,
is amended in paragraph (b) of the definition “private land”
by striking out “as defined in subsection 1(1)” and substituting “as
defined in section 1”.
15(2) Paragraph 39(b) of the Act is
amended by striking out “subsection 16(1)” and substituting “subsection
23(1)”.
Statute of Frauds
16 Section
6 of the Statute of Frauds, chapter S-14 of the Revised Statutes,
1973, is amended by striking out “section 22” and substituting “section 36”.
Provincial Offences
Procedure Act
17 Paragraph
49(2)(b) of the Provincial Offences Procedure Act, chapter P-22.1
of the Acts of New Brunswick, 1987, is amended by striking out “section
7” and substituting “section
11”.
Liquor Control Act
18(1) Subsection 72.1(1) of the Liquor
Control Act, chapter L-10 of the Revised Statutes, 1973, is repealed
and the following is substituted:
72.1(1)
It is a condition of every licence of a class referred to in paragraphs 63(b), (b.1), (c), (d), (e), (g), (h),
(i) and (j) that the licensee comply with section 6, subsection 7(1)
and section 8 of the Smoke-free Places
Act within the premises in respect of which the licence has
been issued.
18(2) Subsection 124.42(1) of the Act
is repealed and the following is substituted:
124.42(1)
Despite any other provision of this Act, the Minister, without a hearing
and in accordance with the regulations, may cancel a licence of a
class referred to in subsection 72.1(1)
or suspend the licence for a period of time the Minister considers
appropriate if the licensee has been convicted of an offence under
section 6, subsection 7(1) or section 8 of the Smoke-free Places Act that took
place within the premises in respect of which the licence was issued.

Relations Act
19 Section
61 of the Public Service Labour Relations Act, chapter P-25 of the
Revised Statutes, 1973, is amended by striking out “section
62” and substituting “section
56”.
New Brunswick Highway
Corporation Act
20 Subsection
22(1) of the New Brunswick Highway Corporation Act, chapter N-5.11
of the Acts of New Brunswick, 1995, is amended by striking out “for
the purposes of subsection 23(1)” and substituting “for the purposes of subsection 17(1)”.
Securities Act
21 Subsection
25(1) of the Securities Act, chapter S-5.5 of the Acts of New Brunswick,
2004, is amended by striking out “for the purposes of subsection
23(1)” and substituting “for the purposes of subsection 17(1)”.
Commencement
22 This Act or any provision of it comes into
force on a day or days to be fixed by proclamation.
