An Act to Amend the Early Childhood Services Act
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 The Early Childhood Services Act, chapter E-0.5 of the Acts of New Brunswick, 2010, is amended by adding after section 2 the following:
Policies and guidelines
2.01( 1) The Minister may establish provincial policies and guidelines related to programs and services.
2.01( 2) A policy or guideline made under subsection (1) shall be published by the Minister as soon as practicable on the Department of Education and Early Childhood Development website.
2.01( 3) The Regulations Act does not apply to provincial policies and guidelines established under subsection (1).
2 The heading “Policies and guidelines” preceding section 2.3 of the Act is repealed.
3 Section 2.3 of the Act is repealed.
4 Subsection 5(1) of the Act is amended by striking out “in the prescribed form” and substituting “on a form provided by the Minister”.
5 Subsection 10(2) of the Act is amended
(a)  in paragraph (c) by striking out “Minister” and substituting “Minister of Social Development”;
(b)  in paragraph (d) by striking out “Minister” and substituting “Minister of Social Development”.
6 Subsection 11(1) is amended by striking out “in the prescribed form” and substituting “on a form provided by the Minister”.
7 Subsection 18(6) of the French version of the Act is amended by striking out “suivie” and substituting “achevée”.
8 Section 25 of the Act is amended by striking out “A statement” and substituting “Despite the Right to Information and Protection of Privacy Act, a statement”.
9 Paragraph 40(1)c) of the French version of the Act is amended by striking out “de la présente loi et de ses règlements” and substituting “réglementaires”.
10 Subsection 46(1) of the French version of the Act is amended by striking out “une personne” and substituting “un parent”.
11 Section 55 of the Act is amended
(a)  in subsection (3)
( i) by repealing paragraph (b);
( ii) in paragraph (d) by striking out “or the Family Services Act”;
(b)  by repealing subsection (4).
12 Section 60 of the Act is amended
(a)  in subsection (1) in the portion preceding paragraph (a) by striking out “Part II” and substituting “Part 2”;
(b)  in subsection (2) by striking out “Part II” and substituting “Part 2”.
13 Section 63 of the Act is amended
(a)  in paragraph (a.1) of the English version by striking out “concerning children” and substituting “for children”;
(b)  by adding after paragraph (c) the following:
(c.1)  establishing different classes of staff members;
(c)  in subparagraph d)(viii) of the French version by striking out “personne” and substituting “personnel”;
(d)  in paragraph n) of the French version by striking out “suivie” and substituting “achevée”;
(e)  in subparagraph aa)(ii) of the French version by striking out “classes de personnes” and substituting “catégories de personnes”;
(f)  by repealing paragraph (ii) and substituting the following:
(ii)  prescribing forms and authorizing the Minister to provide forms for the purposes of this Act and the regulations;
