An Act to Amend the Franchises Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 Subsection 1(1) of the Franchises Act, chapter F-23.5 of the Acts of New Brunswick, 2007, is amended in the French version

(a)  in the definition « assertion inexacte » by striking out “fait important” wherever it appears and substituting “fait substantiel”;

(b)  by repealing the definition « fait important » and substituting the following:

« fait substantiel » Tout renseignement sur l’entreprise, l’exploitation, le capital ou le contrôle du franchiseur ou de la personne qui a un lien avec lui, sur la franchise ou sur le système de franchise, dont il serait raisonnable de s’attendre qu’il aura un effet considérable sur la valeur ou le prix de la franchise à concéder ou sur la décision de l’acquérir. (material fact)

2 Subsection 5(5) of the French version of the Act is amended by striking out “faits importants” and substituting “faits substantiels”.

CONSEQUENTIAL AMENDMENTS

Regulation under the Franchises Act

3 Form 1 of the French version of New Brunswick Regulation 2010-92 under the Franchises Act is amended

(a)  in paragraph a) by striking out “fait important” and substituting “fait substantiel”;

(b)  in paragraph c) by striking out “faits importants” and substituting “faits substantiels”;

(c)  in the portion following the signature line by striking out “fait important” wherever it appears and substituting “fait substantiel”.
