An Act Respecting the Revised Statutes, 2014
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
Business Corporations Act
1 Paragraph 195(b) of the Business Corporations Act, chapter B-9.1 of the Acts of New Brunswick, 1981, is amended in the French version by striking out “Loi sur les corporations étrangères résidantes” and substituting “Loi sur les personnes morales étrangères résidantes”.
Elections Act
2( 1) Section 2 of the Elections Act, chapter E-3 of the Revised Statutes, 1973, is amended in the definition “scheduled general election” by striking out “subsection 2(4)” and substituting “subsection 3(4)”.
2( 2) Section 4 of the Act is amended by striking out “section 21” and substituting “section 20”.
2( 3) Section 4.1 of the Act is amended by striking out “section 21” and substituting “section 20”.
2( 4) Subsection 15(1) of the Act is amended by striking out “section 24” and substituting “section 27”.
Enforcement of Money Judgments Act
3 Section 1 of the Enforcement of Money Judgments Act, chapter 23 of the Acts of New Brunswick, 2013, is amended in the definition “Chief Sheriff” by striking out “subsection 3(1) or (2)” and substituting “subsection 4(1) or (2)”.
Regulation under the Foreign Resident Corporations Act
4( 1) The enacting clause of New Brunswick Regulation 84-274 under the Foreign Resident Corporations Act is repealed and the following is substituted:
Under section 21 of the Foreign Resident Corporations Act, the Lieutenant-Governor in Council makes the following Regulation:
4( 2) Section 1 of the French version of the Regulation is repealed and the following is substituted:
1 Règlement général - Loi sur les personnes morales étrangères résidantes.
4( 3) Section 2 of the Regulation is repealed and the following is substituted:
2 In this Regulation, “Act” means the Foreign Resident Corporations Act. (Loi)
4( 4) Section 3 of the French version of the Regulation is amended by striking out “corporation” and substituting “personne morale”.
4( 5) Section 5 of the French version of the Regulation is amended by striking out “corporation” and substituting “personne morale”.
Members’ Conflict of Interest Act
5 Subsection 43(4) of the Members’ Conflict of Interest Act, chapter M-7.01 of the Acts of New Brunswick, 1999, is amended by striking out “section 24” and substituting “section 27”.
Members’ Pension Act
6 Section 1 of the Members’ Pension Act, chapter M-7.1 of the Acts of New Brunswick, 1993, is amended in the definition “indemnity” by striking out “under subsection 25(1) of the Legislative Assembly Act, as adjusted from time to time under section 25 of that Act” and substituting “under subsection 28(2) of the Legislative Assembly Act, as adjusted from time to time under section 28 of that Act”.
Members Superannuation Act
7( 1) Section 1 of the Members Superannuation Act, chapter M-8 of the Revised Statutes, 1973, is amended in the definition “indemnity” by striking out “under subsection 25(1) of the Legislative Assembly Act, as adjusted from time to time under section 25 of that Act” and substituting “under subsection 28(2) of the Legislative Assembly Act, as adjusted from time to time under section 28 of that Act”.
7( 2) Subsection 6(1) of the Act is amended by striking out “Legislative Assembly Act” and substituting “Legislative Assembly Act, chapter L-3 of the Revised Statutes, 1973,”.
Real Property Tax Act
8 Section 5.01 of the Real Property Tax Act, chapter R-2 of the Revised Statutes, 1973, is amended
(a) in subsection (1) in the definition “rate” by striking out “subsection 3(2)” and substituting “subsection 5(2)”;
(b) in paragraph (3)(f) by striking out “subsection 3(1)” and substituting “subsection 5(1)”;
(c) in paragraph (5)(g) by striking out “subsection 3(2)” and substituting “subsection 5(2)”.
Salvage Dealers Licensing Act
9( 1) Paragraph 2(2)(a) of the Salvage Dealers Licensing Act, chapter S-3 of the Revised Statutes, 1973, is amended by striking out “section 10.1” and substituting “section 12”.
9( 2) Paragraph 21(1)(b) of the Act is amended by striking out “section 10.1” and substituting “section 12”.
Commencement
10 This Act shall be deemed to have come into force on February 9, 2015.
