An Act to Amend the Executive Council Act
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 The Executive Council Act, chapter 152 of the Revised Statutes, 2011, is amended by adding before section 1 the following:
Definition of “fiscal year”
0.1 In this Act, “fiscal year” means the period commencing on April 1 in one year and ending on March 31 in the next year.
2 Section 6 of the Act is amended
(a) by adding after subsection (1) the following:
6( 1.1) Despite subsection (1), for the period commencing on April 1, 2015, and ending on March 31, 2016, and for each consecutive fiscal year in which the Province reports a deficit in the Public Accounts, the Minister of Finance shall pay an annual salary of $47,353 in monthly instalments to
(a) each Minister appointed under section 2,
(b) each member of the Executive Council prescribed duties under subsection 3(1), and
(c) each member of the Executive Council to, in or on whom a right, power, duty, function, responsibility or authority is transferred, vested or imposed under subsection 3(2).
(b) by adding after subsection (2) the following:
6( 2.1) Despite subsection (2), for the period commencing on April 1, 2015, and ending on March 31, 2016, and for each consecutive fiscal year in which the Province reports a deficit in the Public Accounts, the Minister of Finance shall pay to the Premier an annual salary of $67,150 in monthly instalments and an allowance of $2,500 annually for expenses incidental to the discharge of his or her duties as Premier.
(c) in subsection (3) by striking out “under subsection (1) or (2)” and substituting “under subsection (1), (1.1), (2) or (2.1)”;
(d) by adding after subsection (3) the following:
6( 3.1) Despite subsection (3), for the period commencing on April 1, 2015, and ending on March 31, 2016, and for each consecutive fiscal year in which the Province reports a deficit in the Public Accounts, the Minister of Finance shall pay to each member of the Executive Council not in receipt of a salary under subsection (1), (1.1), (2) or (2.1) an annual salary of $35,550 in monthly instalments.
3 Section 7 of the Act is amended by adding after subsection (5) the following:
7( 6) Subsections (1) to (5) do not apply during the period commencing on April 1, 2015, and ending on March 31, 2016, and for each consecutive fiscal year in which the Province reports a deficit in the Public Accounts.
CONSEQUENTIAL AMENDMENTS
Legislative Assembly Act
4( 1) Subsection 20(1) of the Legislative Assembly Act, chapter 116 of the Revised Statutes, 2014, is amended by striking out “paid to a member of the Executive Council under subsection 6(1) and section 7 of the Executive Council Act” and substituting “provided for in subsection 6(1) and subsections 7(1) to (5) of the Executive Council Act”.
4( 2) Section 28 of the Act is amended
(a) in subsection (12) by striking out “paid to the Premier under the Executive Council Act” and substituting “provided for in subsection 6(2) and subsections 7(1) to (5) of the Executive Council Act”;
(b) in subsection (16) by striking out “paid to the Premier under the Executive Council Act” and substituting “provided for in subsection 6(2) and subsections 7(1) to (5) of the Executive Council Act”.
