An Act to Amend the Maritime Provinces Harness Racing Commission Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 The title of the Maritime Provinces Harness Racing Commission Act, chapter 119 of the Revised Statutes, 2014, is repealed and the following is substituted:

Atlantic Provinces Harness Racing Commission Act

2 Section 1 of the Act is amended

(a)  by repealing the definition “Maritime Provinces”;

(b)  by repealing the definition “Commission” and substituting the following:

“Commission” means the body continued under subsection 3(1) under the name Atlantic Provinces Harness Racing Commission. (Commission)

(c)  by repealing the definition “Council” and substituting the following:

“Council” means the Council of Atlantic Premiers established by a memorandum of understanding dated May 15, 2000. (Conseil)

(d)  by repealing the definition “Minister” and substituting the following:

“Minister” means the member of the Executive Council designated by the Lieutenant-Governor in Council to administer this Act. (ministre)

(e)  by adding the following definition in alphabetical order:

“Atlantic Provinces” means the Province of New Brunswick, the Province of Nova Scotia, the Province of Prince Edward Island and the Province of Newfoundland and Labrador. (provinces de l’Atlantique)

3 Section 2 of the Act is amended by striking out “Maritime Provinces” and substituting “Atlantic Provinces”.

4 The heading “Establishment of Commission” preceding section 3 of the Act is repealed and the following is substituted:

5 Section 3 of the Act is repealed and the following is substituted:

Continuation of Commission

3( 1) The body established as the Maritime Provinces Harness Racing Commission by the Council of Maritime Premiers established under the Council of Maritime Premiers Act is continued under the name Atlantic Provinces Harness Racing Commission.

3( 2) The Commission has unified jurisdiction throughout the Atlantic Provinces.

3( 3) Subject to subsection (5), the Council shall appoint the members of the Commission.

3( 4) The change of the name of the Commission does not affect its rights and obligations, and all proceedings may be continued or commenced by and against the Commission under its new name that might have been continued or commenced by or against the Commission under its former name.

3( 5) A member of the Commission who held office immediately before the commencement of this subsection continues in office until the member resigns or is reappointed or replaced.

6 Section 4 of the Act is amended

(a)  in subsection (1) by striking out “six” and substituting “eight”;

(b)  in subsection (3) by striking out “Maritime Provinces” and substituting “Atlantic Provinces”.

7 Subsection 5(2) of the Act is repealed and the following is substituted:

5( 2) Five members of the Commission constitute a quorum with at least one member from each of the Atlantic Provinces being present.

8 Subsection 7(3) of the Act is repealed and the following is substituted:

7( 3) The Commission shall prepare an annual budget that shall be submitted to the Council and included in the budget of the Council submitted to the Lieutenant-Governor in Council.

9 Section 14 of the Act is amended by striking out “Maritime Provinces” and substituting “Atlantic Provinces”.

10 Section 15 of the Act is amended

(a)  in paragraph (1)(b) by striking out “Maritime Provinces” and substituting “Atlantic Provinces”;

(b)  in subsection (2) by striking out “Maritime Provinces” and substituting “Atlantic Provinces”.

TRANSITIONAL PROVISIONS, CONSEQUENTIAL AMENDMENTS AND COMMENCEMENT

Transitional provisions

11( 1) If in an Act, other than this Act, or in a regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Maritime Provinces Harness Racing Commission Act, it shall be read, unless the context otherwise requires, as a reference to the Atlantic Provinces Harness Racing Commission Act.

11( 2) If in an Act, other than this Act, or in a regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Maritime Provinces Harness Racing Commission, it shall be read, unless the context otherwise requires, as a reference to the Atlantic Provinces Harness Racing Commission.

Regulation under the Maritime Provinces Harness Racing Commission Act

12( 1) The enacting clause of New Brunswick Regulation 2003-1 under the Maritime Provinces Harness Racing Commission Act is amended by striking out “section 19.2 of the Maritime Provinces Harness Racing Commission Act” and substituting “section 17 of the Atlantic Provinces Harness Racing Commission Act”.

12( 2) The heading “Citation” preceding section 1 of the French version of the Regulation is repealed and the following is substituted:

1 This Regulation may be cited as the General Regulation - Atlantic Provinces Harness Racing Commission Act.

12( 4) Section 2 of the Regulation is amended by repealing the definition “Act” and substituting the following:

“Act” means the Atlantic Provinces Harness Racing Commission Act; (Loi)

Commencement

13 This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
