An Act Respecting the Trustees Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

Adult Education and Training Act

1 Section 6 of the Adult Education and Training Act, chapter 101 of the Revised Statutes, 2011, is amended by striking out “in securities authorized by the Trustees Act as investments in which the trustees or executors may invest money” and substituting “in the manner authorized by the Trustees Act”.

Regulation under the Firefighters’ Compensation Act

2 Paragraph 8(2)(d) of New Brunswick Regulation 2009-72 under the Firefighters’ Compensation Act is amended by striking out “Part II of the Trustees Act” and substituting “Division C of Part 4 of the Trustees Act”.

Infirm Persons Act

3 Section 2 of the Infirm Persons Act, chapter I-8 of the Revised Statutes, 1973, is repealed.

Interpretation Act

4 Section 38 of the Interpretation Act, chapter I-13 of the Revised Statutes, 1973, is amended by repealing the definition “Authorized Trustee Investment”.

Rules of Court

5 Rule 11 of the Rules of Court of New Brunswick, New Brunswick Regulation 82-73 under the Judicature Act and the Provincial Offences Procedure Act, is amended in clause 11.01(1)(d) by striking out “section 26 of the Trustees Act” and substituting “Part 5 of the Trustees Act”.

Municipal Debentures Act

6 Subsection 23(1) of the Municipal Debentures Act, chapter M-21 of the Revised Statutes, 1973, is amended by striking out “authorized by the Trustees Act and”.

New Brunswick Housing Act

7 Paragraph 14(1)(d) of the New Brunswick Housing Act, chapter N-6 of the Revised Statutes, 1973, is amended by striking out “in securities authorized by the Trustees Act as investments in which trustees or executors may invest trust money” and substituting “in the manner authorized by the Trustees Act”.

Premier’s Council on the Status of Disabled Persons Act

8 Subsection 12(1) of the Premier’s Council on the Status of Disabled Persons Act, chapter 208 of the Revised Statutes, 2011, is amended by striking out “in securities authorized by the Trustees Act as investments in which trustees or executors may invest money” and substituting “in the manner authorized by the Trustees Act”.

Presumption of Death Act

9 Subsection 6(5) of the Presumption of Death Act, chapter 110 of the Revised Statutes, 2012, is amended by striking out “within the meaning of the Trustees Act”.

Workers’ Compensation Act

10 Subsection 72(1) of the Workers’ Compensation Act, chapter W-13 of the Revised Statutes, 1973, is amended by striking out “Trustees Act” and substituting “Devolution of Estates Act”.

Regulation under the Workers’ Compensation Act

11 Paragraph 3(1)(d) of New Brunswick Regulation 82-210 under the Workers’ Compensation Act is amended by striking out “Part II of the Trustees Act” and substituting “Division C of Part 4 of the Trustees Act”.

Workplace Health, Safety and Compensation Commission and Workers’ Compensation Appeals Tribunal Act

12 Paragraph 24(1)(a) of the Workplace Health, Safety and Compensation Commission and Workers’ Compensation Appeals Tribunal Act, chapter W-14 of the Acts of New Brunswick, 1994, is amended by striking out “in any securities that are under the Trustees Act, a proper investment for trust funds, except mortgages on real estate” and substituting “in the manner authorized by the Trustees Act, but not in mortgages on real estate”.

Commencement

13 This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
