BILL 9

An Act Respecting the Right to Work

 

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

 

1                  The Procurement Act, chapter 20 of the Acts of New Brunswick, 2012, is amended by adding after section 9 the following:

 

9.1               Where the conditions of a contract to purchase a service are altered after the fact by the application by the Minister of new requirements having to do with the provision of the service in both or either of the official languages of New Brunswick, the Minister shall be required to accommodate the supplier to ensure

 

(a)          the provision of the service, and

 

(b)          that any employees affected by the altered service level maintain their employment standing.

 

2                  The Civil Service Act, chapter C-5.1 of the Acts of New Brunswick, 1984, is amended by adding after subsection 26(4) the following:

 

26(5)          When the services of an employee are reduced or no longer required because of application by the Minister of new requirements having to do with the provision of the service in both or either of the official languages of New Brunswick, the deputy head shall maintain the employment status, including pay band, pay scale, and regular working hours of the employee, but may reassign the employee to perform other appropriate duties.
