An Act Respecting Agreements with the Canada Revenue Agency
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
Family Income Security Act
1 The Family Income Security Act, chapter 154 of the Revised Statutes, 2011, is amended by adding after section 8 the following:
Agreements with Canada Revenue Agency
8.1( 1) Despite the Right to Information and Protection of Privacy Act and for the purposes of this Act, the Minister may enter into agreements with the Canada Revenue Agency to collect, use or disclose tax information, including personal information, to establish eligibility for assistance.
8.1( 2) Prior to entering into an agreement under subsection (1), the Minister shall obtain the consent of the applicant for assistance or of the recipient, as the case may be.
Family Services Act
2 The Family Services Act, chapter F-2.2 of the Acts of New Brunswick, 1980, is amended by adding after section 11 the following:
Contracts with Canada Revenue Agency
11.01 For the purposes of this Act, the Minister may enter into contracts with the Canada Revenue Agency to collect, use or disclose tax information, including personal information, of a person who is eligible to receive a service or benefit under this Act, with the consent of the person.
New Brunswick Housing Act
3 The New Brunswick Housing Act, chapter N-6 of the Revised Statutes, 1973, is amended by adding after section 2 the following:
Agreements with Canada Revenue Agency
2.1( 1) Despite the Right to Information and Protection of Privacy Act and for the purposes of this Act, the Minister may enter into agreements with the Canada Revenue Agency to collect, use or disclose tax information, including personal information, to establish eligibility for financial or other assistance.
2.1( 2) Prior to entering into an agreement under subsection (1), the Minister shall obtain the consent of the applicant.
Nursing Homes Act
4 Section 23 of the Nursing Homes Act, chapter 125 of the Revised Statutes, 2014, is amended by adding after subsection (2) the following:
23( 3) Despite the Right to Information and Protection of Privacy Act and for the purposes of this Act, the Minister may enter into agreements with the Canada Revenue Agency to collect, use or disclose tax information, including personal information, to establish eligibility for assistance.
23( 4) Prior to entering into an agreement under subsection (3), the Minister shall obtain the consent of the person whose eligibility is being established.
