An Act to Amend the Political Process Financing Act

 

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

 

1                 Subsection 1(1) of the Political Process Financing Act, chapter P-9.3 of the Acts of New Brunswick, 1978, is amended

 

(a)          by repealing the definition “corporation”;

 

(b)          in the definition “financing” by striking out “, corporation or trade union”;

 

(c)          by repealing the definition “trade union”.

 

2                 Subsection 1(3) of the Act is repealed.

 

3                 Subsection 37(1) of the Act is amended by striking out “, corporations and trade unions”.

 

4                 Subsection 38(1) of the Act is repealed and the following is substituted:

 

38(1)          An individual may make a contribution only out of his own property.

 

5                 Subsection 38(2) of the Act is amended

 

(a)          in the portion preceding paragraph (a) by striking out “, corporation or trade union”;

 

(b)          in paragraph (b) by striking out “or it”.

 

6                 Section 39 of the Act is amended

 

(a)          in subsection (1) in the portion preceding paragraph (a) by striking out “, corporation or trade union”;

 

(b)          in subsection (1.2) by striking out “, corporation or trade union”;

 

(c)          in subsection (1.3) by striking out “, corporation or trade union”;

 

(d)          in subsection (1.4) by striking out “, corporation or trade union”.

 

7                 Paragraph 46(2)(c) of the Act is repealed.

 

8                 Paragraph 46.1(2)(c) of the Act is repealed.

 

9                 Paragraph 58(1)(h) of the Act is repealed.

 

10               Subparagraph 62.1(2)(b)(iii) of the Act is amended

 

(a)          by repealing clause (C);

 

(b)          by repealing clause (D).

 

11               Subparagraph 62.1(2)(b)(iv) of the Act is repealed and the following is substituted:

 

(iv)    the name and full address of each individual, if any, that became surety or guarantor on behalf of the leadership contestant or nomination contestant and the amount for which the individual became surety or guarantor;

 

12               Section 84.1 of the Act is amended in the definition “third party” by striking out “or group”.

 

13               Subsection 84.3(3) of the Act is repealed and the following is substituted:

 

84.3(3)       An application for registration shall be sent to the Supervisor and shall include the name, address, telephone number and signature of the third party.

 

14               Subsection 84.5(1) of the Act is repealed and the following is substituted:

 

84.5(1)       A third party shall only accept election advertising contributions from individuals who are ordinarily resident in the Province.

 

15               Subsection 84.5(4) of the Act is repealed.

 

16               Subsection 85(5) of the Act is repealed.

 

17               This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
