An Act Respecting Government Reorganization
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
PART 1
AMENDMENTS TO
THE EXECUTIVE COUNCIL ACT
Executive Council Act
1 Section 2 of the Executive Council Act, chapter 152 of the Revised Statutes, 2011, is repealed and the following is substituted:
2 Under the Great Seal of the Province, the Lieutenant-Governor in Council may appoint from among the members of the Executive Council the following Ministers who shall hold office during pleasure: a President of the Executive Council, a Minister of Agriculture, Aquaculture and Fisheries, an Attorney General, a Minister of Economic Development, a Minister of Education and Early Childhood Development, a Minister of Energy and Resource Development, a Minister of Environment and Local Government, a Minister of Families and Children, a Minister of Finance, a Minister of Health, a Minister of Justice and Public Safety who shall also be Solicitor General, a Minister of Post-Secondary Education, Training and Labour, a Minister of Seniors and Long-Term Care, a Minister of Service New Brunswick, a President of Treasury Board, a Minister of Tourism, Heritage and Culture, and a Minister of Transportation and Infrastructure.
TRANSITIONAL PROVISIONS
References to Ministers, Deputy Ministers and Departments
2( 1) When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Energy and Mines, it shall be read, unless the context otherwise requires, as a reference to the Minister, Deputy Minister or Department of Energy and Resource Development.
2( 2) When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Finance, it shall be read, unless the context otherwise requires, as a reference to
(a)  the Minister, Deputy Minister or Department of Finance, or
(b)  the President or Deputy Minister of the department called Treasury Board or to the department called Treasury Board,
as the case may be.
2( 3) When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Healthy and Inclusive Communities, it shall be read, unless the context otherwise requires, as a reference to
(a)  the Minister, Deputy Minister or Department of Tourism, Heritage and Culture,
(b)  the Minister of Families and Children,
(c)  the Minister of Seniors and Long-Term Care,
(d)  both the Minister of Families and Children and the Minister of Seniors and Long-Term Care, or
(e)  the Deputy Minister or Department of Social Development,
as the case may be.
2( 4) When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Human Resources, it shall be read, unless the context otherwise requires, as a reference to the President or Deputy Minister of the department called Treasury Board or to the department called Treasury Board.
2( 5) When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Justice, it shall be read, unless the context otherwise requires, as a reference to the Minister, Deputy Minister or Department of Justice and Public Safety.
2( 6) When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Natural Resources, it shall be read, unless the context otherwise requires, as a reference to the Minister, Deputy Minister or Department of Energy and Resource Development.
2( 7) When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Public Safety, it shall be read, unless the context otherwise requires, as a reference to the Minister, Deputy Minister or Department of Justice and Public Safety.
2( 8) When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister responsible for Service New Brunswick, it shall be read, unless the context otherwise requires, as a reference to the Minister of Service New Brunswick.
2( 9) When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister of Social Development, it shall be read, unless the context otherwise requires, as a reference to
(a)  the Minister of Families and Children,
(b)  the Minister of Seniors and Long-Term Care, or
(c)  both the Minister of Families and Children and the Minister of Seniors and Long-Term Care,
as the case may be.
Confirmation and ratification – general
3( 1) Any act or thing done from June 6, 2016, to the date of the enactment of this section, both dates inclusive, by the Minister of Economic Development, the Minister of Energy and Resource Development, the Minister of Families and Children, the Minister of Justice and Public Safety, the Minister of Seniors and Long-Term Care, the Minister of Service New Brunswick or the President of Treasury Board, in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those Ministers with respect to any Act, or any particular matter or thing under the administration, supervision or control of those Ministers
(a)  shall be deemed to have been done by persons validly appointed to exercise or perform the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those Ministers,
(b)  shall be deemed to constitute a valid exercise or performance of the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those Ministers, and
(c)  is confirmed and ratified.
3( 2) Nothing in paragraphs (1)(a) and (b) shall be taken as providing any indication that any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the Ministers referred to in subsection (1) was not validly exercised or performed.
Confirmation and ratification – Minister of Healthy and Inclusive Communities
4( 1) Any act or thing done from April 1, 2015, to June 5, 2016, both dates inclusive, by a member of the Executive Council, in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the Minister of Healthy and Inclusive Communities with respect to any Act, or any particular matter or thing under the administration, supervision or control of the Minister of Healthy and Inclusive Communities
(a)  shall be deemed to have been done by a person validly appointed to exercise or perform the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on that Minister,
(b)  shall be deemed to constitute a valid exercise or performance of the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on that Minister, and
(c)  is confirmed and ratified.
4( 2) Nothing in paragraphs (1)(a) and (b) shall be taken as providing any indication that any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the Minister of Healthy and Inclusive Communities was not validly exercised or performed.
Confirmation and ratification – Minister responsible for Service New Brunswick
5( 1) Any act or thing done from October 1, 2015, to June 5, 2016, both dates inclusive, by a member of the Executive Council, in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the Minister responsible for Service New Brunswick with respect to any Act, or any particular matter or thing under the administration, supervision or control of the Minister responsible for Service New Brunswick
(a)  shall be deemed to have been done by a person validly appointed to exercise or perform the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on that Minister,
(b)  shall be deemed to constitute a valid exercise or performance of the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on that Minister, and
(c)  is confirmed and ratified.
5( 2) Nothing in paragraphs (1)(a) and (b) shall be taken as providing any indication that any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the Minister responsible for Service Brunswick was not validly exercised or performed.
Appointments, confirmation and ratification – deputy heads
6( 1) The Lieutenant-Governor in Council may make the initial appointments of deputy heads under section 3 of the Civil Service Act retroactive to June 6, 2016, for the Department of Energy and Resource Development, the Department of Finance, the Department of Justice and Public Safety and Treasury Board.
6( 2) Any act or thing done by the deputy heads appointed in accordance with subsection (1) from June 6, 2016, to the date of the enactment of this section, both dates inclusive, in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those deputy heads,
(a)  shall be deemed to have been done by persons validly appointed to exercise or perform the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those deputy heads,
(b)  shall be deemed to constitute a valid exercise or performance of the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those deputy heads, and
(c)  is confirmed and ratified.
6( 3) Nothing in paragraphs (2)(a) and (b) shall be taken as providing any indication that any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the deputy heads appointed in accordance with subsection (1) was not validly exercised or performed.
Immunity – Ministers and deputy heads
7 No action, application or any other proceeding to question or in which is questioned the validity of the appointment of the Ministers referred to in subsection 3(1), 4(1) or 5(1) or the deputy heads appointed in accordance with subsection 6(1), or the authority of those Ministers or deputy heads to act in that capacity, lies or shall be instituted against
(a)  the Crown in right of the Province,
(b)  the Ministers referred to in subsection 3(1), with respect to any act or thing done from June 6, 2016, to the date of the enactment of this section, both dates inclusive, by those Ministers in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those Ministers with respect to any Act, or any particular matter or thing under the administration, supervision or control of those Ministers,
(c)  a member of the Executive Council to whom subsection 4(1) applies, with respect to any act or thing done from April 1, 2015, to June 5, 2016, both dates inclusive, by that person in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the Minister of Healthy and Inclusive Communities with respect to any Act, or any particular matter or thing under the administration, supervision or control of the Minister of Healthy and Inclusive Communities,
(d)  a member of the Executive Council to whom subsection 5(1) applies, with respect to any act or thing done from October 1, 2015, to June 5, 2016, both dates inclusive, by that person in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the Minister responsible for Service New Brunswick with respect to any Act, or any particular matter or thing under the administration, supervision or control of that Minister,
(e)  the deputy heads appointed in accordance with subsection 6(1), with respect to any act or thing done by those deputy heads from June 6, 2016, to the date of the enactment of this section, both dates inclusive, in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those deputy heads, or
(f)  any other person appointed, assigned, designated or requested to assist the Ministers referred to in subsection 3(1), 4(1) or 5(1) or the deputy heads appointed in accordance with subsection 6(1) regarding the administration, supervision or enforcement of any Act with respect to which any right, power, duty, function, responsibility or authority is transferred to, vested in or imposed on those Ministers, regarding a particular matter or thing under the administration, supervision or control of those Ministers, or regarding any right, power, duty, function, responsibility or authority that is transferred to, vested in or imposed on those deputy heads, with respect to any act or thing done, within the meaning of this paragraph, by the other person,
if those Ministers, deputy heads or other persons acted in good faith in doing the act or thing.
Confirmation and ratification – Board of Management
8( 1) Any act or thing done from June 6, 2016, to the commencement of this section, both dates inclusive, by the board called Board of Management in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the board called Treasury Board with respect to any Act, or any particular matter or thing under the administration, supervision or control of the board
(a)  shall be deemed to have been done by the board validly constituted to exercise or perform the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the board called Treasury Board,
(b)  shall be deemed to constitute a valid exercise or performance of the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the board called Treasury Board, and
(c)  is confirmed and ratified.
8( 2) Nothing in paragraphs (1)(a) and (b) shall be taken as providing any indication that any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the board called Treasury Board referred to in subsection (1) was not validly exercised or performed.
Immunity – Board of Management
9 No action, application or any other proceeding to question or in which is questioned the validity of the exercise or performance of the rights, powers, duties, functions, responsibilities or authorities transferred to, vested in or imposed on the board called Treasury Board lies or shall be instituted against any member of the board called Board of Management to whom section 8 applies, with respect to any act or thing done by the board called Board of Management from June 6, 2016, to the commencement of this section, both dates inclusive, in the exercise or performance or intended exercise or performance of any rights, powers, duties, functions, responsibilities or authorities transferred to, vested in or imposed on the board called Treasury Board, if those members acted in good faith in doing the act or thing.
CONSEQUENTIAL AMENDMENTS
Adult Education and Training Act
10( 1) Section 1 of the Adult Education and Training Act, chapter 101 of the Revised Statutes, 2011, is amended in the definition “prescribed training services” by striking out “Board of Management” and substituting “Treasury Board”.
10( 2) Section 4 of the Act is amended
(a)  in subsection (7) by striking out “Board of Management” and substituting “Treasury Board”;
