An Act to Amend the Edmundston Act, 1998

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 Section 1 of the Edmundston Act, 1998, chapter E-1.111 of the Acts of New Brunswick, 1998, is amended

(a)  in subsection (1) by repealing the definition “quorum”;

(b)  in subsection (2) by striking out “created” and substituting “continued”;

(c)  by repealing subsection (3).

2 Section 2 of the Act is repealed and the following is substituted:

Edmundston

2( 1) The city called Edmundston is continued.

2( 2) The parcel of land identified as NB PID #35349224, being an area contiguous to Edmundston, is annexed to Edmundston and the new territorial limits of Edmundston are shown on the plan attached as Schedule A.

2( 3) The effective date of the annexation is January 1, 2019.

2( 4) The inhabitants of the area referred to in subsection (2) continue as Edmundston.

3 The heading “FIRST COUNCIL” following section 4 of the Act is repealed.

4 The heading “Application of the Municipal Elections Act” preceding section 5 of the Act is repealed.

5 Section 5 of the Act is repealed.

6 The heading “Residency” preceding section 6 of the Act is repealed.

7 Section 6 of the Act is repealed.

8 The heading “Eligibility of officer or employee” preceding section 7 of the Act is repealed.

9 Section 7 of the Act is repealed.

10 The heading “Eligibility of member of council” preceding section 8 of the Act is repealed.

11 Section 8 of the Act is repealed.

12 The heading “First election” preceding section 9 of the Act is repealed.

13 Section 9 of the Act is repealed.

14 The heading “Wards” preceding section 10 of the Act is repealed.

15 Section 10 of the Act is repealed.

16 The heading “Voting by wards” preceding section 11 of the Act is repealed.

17 Section 11 of the Act is repealed.

18 The heading “Powers of council of affected municipality” preceding section 12 of the Act is repealed.

19 Section 12 of the Act is repealed.

20 The heading “Powers of first council of Edmundston” preceding section 13 of the Act is repealed.

21 Section 13 of the Act is repealed.

22 The heading “Remuneration of members of first council” preceding section 14 of the Act is repealed.

23 Section 14 of the Act is repealed.

24 The heading “Provision of information” preceding section 15 of the Act is repealed.

25 Section 15 of the Act is repealed.

26 The heading “Powers respecting orderly transition” preceding section 16 of the Act is repealed.

27 Section 16 of the Act is repealed.

28 The heading “Acceptance of office” preceding section 17 of the Act is repealed.

29 Section 17 of the Act is repealed.

30 The heading “Conflict of interest” preceding section 18 of the Act is repealed.

31 Section 18 of the Act is repealed.

32 The heading “Second election” preceding section 19 of the Act is repealed.

33 Section 19 of the Act is repealed.

34 Paragraph 21(b) of the Act is repealed and the following is substituted:

(b)  secondly, be applied towards any outstanding debt of Edmundston.

35 The heading “Composition of council” preceding section 30 of the Act is repealed.

36 Section 30 of the Act is repealed.

37 The heading “Division of municipality into wards” preceding section 31 of the Act is repealed.

38 Section 31 of the Act is repealed.

39 The heading “Taxation zones” preceding section 32 of the Act is repealed.

40 Section 32 of the Act is repealed.

41 The heading “Continuance of borrowing authority” preceding section 33 of the Act is repealed.

42 Section 33 of the Act is repealed.

43 The heading “Pensions” preceding section 34 of the Act is repealed.

44 Section 34 of the Act is repealed.

45 The heading “Payment and services” preceding section 35 of the Act is repealed.

46 Section 35 of the Act is repealed.

CONSEQUENTIAL AMENDMENTS
AND COMMENCEMENT

Regulation under the Education Act

47 Paragraph 4(b) of New Brunswick Regulation 2001-24 under the Education Act is amended by striking out “created” and substituting “continued”.

Electricity Act

48 Paragraph 88(2)(a) of the Electricity Act, chapter 7 of the Acts of New Brunswick, 2013, is repealed and the following is substituted:

(a)  the territorial limits shown on the plan attached as Schedule A of the Edmundston Act, 1998, as that plan existed on the commencement of this paragraph, and

Real Property Tax Act

49 Section 5.01 of the Real Property Tax Act, chapter R-2 of the Revised Statutes, 1973, is amended

(a)  in subsection (1) in the definition “rate” by striking out “the tax rates referred to in paragraph 32(4)(c) of the Edmundston Act, 1998,”;

(b)  by repealing paragraph (3)(c);

(c)  by repealing paragraph (5)(b).

Regulation under the Regional Health Authorities Act

50 Paragraph 6(2)(b) of New Brunswick Regulation 2012-7 under the Regional Health Authorities Act is amended by striking out “created” and substituting “continued”.

Commencement

51 This Act comes into force on January 1, 2019.
