An Act Respecting Extra-Mural Services
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
Accountability and Continuous Improvement Act
1 Schedule A of the Accountability and Continuous Improvement Act, chapter 27 of the Acts of New Brunswick, 2013, is amended
(a)  by striking out “Ambulance New Brunswick Inc.”;
(b)  by adding “EM/ANB Inc.” in alphabetical order.
Ambulance Services Act
2 Section 18.1 of the Ambulance Services Act, chapter A-7.3 of the Acts of New Brunswick, 1990, is amended by striking out “Ambulance New Brunswick Inc.” wherever it appears and substituting “EM/ANB Inc.”.
Health Quality and Patient Safety Act
3 Section 1 of the Health Quality and Patient Safety Act, chapter 21 of the Acts of New Brunswick, 2016, is amended by repealing paragraph (b) of the definition “health care organization” and substituting the following:
(b)  EM/ANB Inc.; and
Regulation under the Medical Services Payment Act
4 Subsection 14(6) of New Brunswick Regulation 84-20 under the Medical Services Payment Act is repealed and the following is substituted:
14( 6) Travelling expenses incurred by a medical practitioner are deemed to be entitled services where the medical practitioner is providing entitled services under the extra-mural service delivered by a regional health authority or by a person under an agreement with the Minister entered into under the Regional Health Authorities Act.
Personal Health Information Privacy and Access Act
5 Section 1 of the Personal Health Information Privacy and Access Act, chapter P-7.05 of the Acts of New Brunswick, 2009, is amended by repealing subparagraph (d)(i) of the definition “custodian” and substituting the following:
( i) EM/ANB Inc.,
Regulation under the Personal Health Information Privacy and Access Act
6 Paragraph 16(d) of New Brunswick Regulation 2010-112 under the Personal Health Information Privacy and Access Act is repealed and the following is substituted:
(d)  EM/ANB Inc.; and
Regulation under the Procurement Act
7 Schedule B of New Brunswick Regulation 2014-93 under the Procurement Act is amended
(a)  by striking out “Ambulance New Brunswick Inc.”;
(b)  by adding “EM/ANB Inc.” in alphabetical order.
Regional Health Authorities Act
8( 1) Section 1 of the Regional Health Authorities Act, chapter 217 of the Revised Statutes, 2011, is amended
(a)  by repealing the definition “extra-mural services” and substituting the following:
“extra-mural services” means (services extra-muraux)
(a)  services prescribed by regulation that are provided to a patient at the patient’s place of residence, the patient’s place of work or another place in a community by a regional health authority, or
(b)  services prescribed by regulation that are provided to a person at the person’s place of residence, the person’s place of work or another place in a community by a person other than a regional health authority under an agreement with the Minister.
(b)  in the definition “health services” by striking out “means” and substituting “means, subject to section 1.1,”.
8( 2) The Act is amended by adding after section 1 the following:
Interpretation of “health services”
1.1( 1) In section 1 in the definition “patient” and in paragraph 6(1)(c), subsection 8(2), paragraph 9(c), Part 3, section 65 and subsection 67(1), “health services” means
(a)  hospital services, addiction services, mental health services, public health services and community health services, and
(b)  extra-mural services referred to in paragraph (a) of the definition “extra-mural services”.
1.1( 2) The second reference to “health services” in section 2 shall be read as health services referred to in paragraphs (1)(a) and (b).
8( 3) Section 2 of the Act is repealed and the following is substituted:
2 The purpose of this Act is to provide for the delivery and administration of health services, including by establishing regional health authorities with responsibility for providing for the delivery and administration of health services in specified geographic areas and, when authorized, in other areas of the Province.
8( 4) Subsection 71(1) of the Act is amended by adding after paragraph (l) the following:
(l.1)  prescribing services for the purposes of paragraph (a) or (b) of the definition “extra-mural services”;
Regulations under the Regional Health Authorities Act
9( 1) New Brunswick Regulation 2002-27 under the Regional Health Authorities Act is amended
(a)  in section 2 in paragraph (c.1) of the definition “privileges” by striking out “a nurse practitioner to admit a patient to the extra-mural service program” and substituting “a nurse practitioner to admit a patient to the extra-mural service delivered by a regional health authority or by a person under an agreement with the Minister”;
(b)  by adding after section 2 the following:
Extra-mural services
2.1( 1) The following services are prescribed for the purposes of paragraph (a) of the definition “extra-mural services” in section 1 of the Act:
(a)  occupational therapy services for children in schools, daycares and outpatient settings;
(b)  physiotherapy services for children in schools, daycares and outpatient settings;
(c)  services for medical assistance in dying;
(d)  medical services; and
(e)  specialized therapeutic and nursing services.
2.1( 2) The following services are prescribed for the purposes of paragraph (b) of the definition “extra-mural services” in section 1 of the Act:
(a)  nursing services;
(b)  occupational therapy services;
(c)  physiotherapy services;
(d)  clinical nutrition services;
(e)  respiratory therapy services;
(f)  social work services; and
(g)  speech-language pathology services for persons with a health care need requiring provision of the services in their home setting.
(c)  in paragraph 15(b) by striking out “in the extra-mural service program delivered by the regional health authority” and substituting “in the extra-mural service delivered by the regional health authority or by a person under an agreement with the Minister”.
9( 2) Paragraph 3(1)(e) of New Brunswick Regulation 2012-7 under the Regional Health Authorities Act is amended by striking out “Ambulance New Brunswick Inc.” and substituting “EM/ANB Inc.”.
Commencement
10 This Act comes into force on January 1, 2018.
