An Act Respecting Canadian Geodetic Vertical Datum

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

Air Space Act

1( 1) Section 1 of the Air Space Act, chapter 109 of the Revised Statutes, 2011, is amended

(a)  by repealing the definition “geodetic elevation”;

(b)  by adding the following definition in alphabetical order:

“orthometric height” means the elevation of a point above the geoid that is (altitude orthométrique)

(a)  based on the Canadian Geodetic Vertical Datum of 2013 (CGVD2013), and

(b)  derived from a benchmark approved by the Director of Surveys.

1( 2) Paragraph 4(d) of the Act is amended by striking out “geodetic elevation” wherever it appears and substituting “orthometric height”.

Mining Act

2 Section 91 of the Mining Act, chapter M-14.1 of the Acts of New Brunswick, 1985, is amended by striking out “the geodetic elevations of those angles shall be based on the Canadian Geodetic Datum authorized by Privy Council Order 630, dated March 11, 1935” and substituting “the orthometric heights of those angles shall be based on the Canadian Geodetic Vertical Datum of 2013 (CGVD2013)”.
