An Act to Amend the Motor Vehicle Act
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Section 1 of the Motor Vehicle Act, chapter M-17 of the Revised Statutes, 1973, is amended by repealing the definition “fictitious registration plate” and substituting the following:
“fictitious registration plate” means a registration plate not furnished and issued by the Division, not furnished and issued for the current registration year or that is attached to a vehicle other than that for which it was issued, but does not include (fausse plaque d’immatriculation)
aa registration plate on a foreign vehicle lawfully operated in New Brunswick,
ba novelty plate not furnished and issued by the Division that is attached to the front of a vehicle that has a gross mass of less than 4 500 kg, or
ca registration plate not furnished and issued for the current registration year that is attached to the front of a motorcycle, an antique vehicle, a trailer, a semi-trailer or a vehicle that has a gross mass of less than 4 500 kg;
2 Section 10 of the English version of the Act is amended by striking out “licence plate” and substituting “registration plate”.
3 Section 17.01 of the French version of the Act is amended by striking out “délivrées” and substituting “délivrés”.
4 The heading “Registration plates” preceding section 29 of the Act is repealed and the following is substituted:
Issuance of registration plates
5 Subsection 29(1) of the Act is repealed and the following is substituted: 
29( 1) On registering a vehicle, the Registrar shall issue to the owner
aone registration plate
( i) for a motorcycle, an antique vehicle, a trailer or a semi-trailer, and
( ii) for a vehicle that has a gross mass of less than 4 500 kg, and
btwo registration plates for a vehicle that has a gross mass of 4 500 kg or more, excluding a vehicle under subparagraph (a)(i), but the Minister may order that only one registration plate shall be issued for a vehicle for the registration year or years specified in the order.
6 The heading “Registration plates” preceding section 30 of the Act is repealed and the following is substituted:
Attachment of registration plates
7 Subsection 30(1) of the Act is repealed and the following is substituted:
30( 1) A registration plate issued under paragraph 29(1)(a) shall be attached to the vehicle in the rear and registration plates issued under paragraph 29(1)(b) shall be attached to the vehicle, one in the front and the other in the rear.
8 The heading “Registration plates” preceding section 31 of the Act is repealed and the following is substituted:
Sticker
9 Section 31 of the Act is amended
aby repealing subsection (1) and substituting the following:
31( 1) Despite section 29, in any registration year, on a renewal of a vehicle registration that was effective for the immediately preceding registration year, the Minister may authorize the Registrar to issue a sticker or stickers instead of a registration plate or plates that may be affixed to the registration plate or plates, the windshield or another part of the vehicle.
bby adding after subsection (1) the following:
31( 1.1) A sticker shall bear the particulars required by the Minister and the Minister shall order in what manner the sticker is to be affixed.
cin subsection (2) by striking out “The device referred to in subsection (1)” and substituting “The sticker”.
10 Subsection 35(2) of the Act is amended in the portion preceding paragraph (a) by striking out “special licence plates” and substituting “special plates”.
11 Section 39.2 of the Act is repealed.
12 Section 68 of the Act is repealed and the following is substituted:
68 Except as otherwise expressly permitted in this Act, no person shall operate or knowingly permit to be operated on a highway any vehicle required to be registered under this Act unless there is
aattached to the vehicle and displayed on the vehicle in the manner provided by section 30 the registration plate or plates issued for the vehicle by the Registrar for the current registration year, or
battached to the vehicle and displayed on the vehicle in the manner provided by section 30 the registration plate or plates issued for the vehicle by the Registrar and affixed to the vehicle in the manner ordered by the Minister the sticker issued for the vehicle by the Registrar for the current registration year.
13 Section 72 of the French version of the Act is amended in the portion preceding paragraph a) by striking out “sa ou ses plaques d’immatriculation” and substituting “sa plaque d’immatriculation”.
14 Subsection 76(1) of the English version of the Act is amended by striking out “licence plate or plates” and substituting “registration plate or plates”.
15 Subsection 248(2.1) of the Act is amended by striking out “stickers” and substituting “inspection stickers”
16 Section 249 of the Act is amended
ain paragraph (m) by striking out “stickers” wherever it appears and substituting “inspection stickers”;
bin paragraph (o) by striking out “stickers” and substituting “inspection stickers”.
17 Section 288 of the English version of the Act is amended
ain subsection (1) by striking out “number plates” and substituting “registration plates”;
bin subsection (2) by striking out “number plates” and substituting “registration plates”;
cin subsection (3) by striking out “number plates” and substituting “registration plates”.
18 Paragraph 310.04(2)a) of the French version of the Act is amended by striking out “son alcoolémie” and substituting “son taux d’alcoolémie”.
19 This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
