An Act to Amend the Judicature Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 The Judicature Act, chapter J-2 of the Revised Statutes, 1973, is amended by adding after section 37 the following:

Enforcement of orders made under the Canadian Free Trade Agreement

37.1( 1) In this section, “Canadian Free Trade Agreement” means the Canadian Free Trade Agreement, signed in 2017 by the Government of Canada and the governments of the provinces and territories of Canada, as amended from time to time.

37.1( 2) A certified copy of an order made by a Presiding Body under Chapter 10 of the Canadian Free Trade Agreement that requires a person other than the Crown to pay tariff costs may be filed with The Court of Queen’s Bench, and, when filed, has the same force and effect as an order for the payment of money made by that Court against the person.
