An Act to Amend the Oil and Natural Gas Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 The Oil and Natural Gas Act, chapter O-2.1 of the Acts of New Brunswick, 1976, is amended by adding before the heading “CONVERSION TO LEASE” preceding section 26 the following:

HYDRAULIC FRACTURING

Hydraulic fracturing

25.1 No person shall hydraulically fracture a well.

2 Section 57 of the Act is amended by repealing subsection (6) and substituting the following:

57( 6) A person who violates or fails to comply with section 25.1 or subsection 44(2) commits an offence punishable under Part II of the Provincial Offences Procedure Act as a category J offence.
