An Act to Amend the Climate Change Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 Section 1 of the Climate Change Act, chapter 11 of the Acts of New Brunswick, 2018, is amended by repealing the following definitions:

“diesel fuel”;

“diesel fuel tax”;

“diesel fuel tax refund”;

“gasoline”;

“gasoline tax”;

“gasoline tax refund”.

2 Paragraph 4(8)(a) of the Act is repealed.

3 The heading “Transfer to the Fund of part of the net revenue from the gasoline tax and the diesel fuel tax” preceding section 6 of the Act is repealed.

4 Section 6 of the Act is repealed.

TRANSITIONAL PROVISION AND COMMENCEMENT

Transitional provision

5( 1) The following definition applies in this section.

“Climate Change Fund” means the Climate Change Fund established under section 4 of the Climate Change Act. (Fonds pour les changements climatiques)

5( 2) On the commencement of this Act, all money in the Climate Change Fund that was transferred by the Minister of Finance to the Climate Change Fund under section 6 of the Climate Change Act, as that section existed before its repeal, shall be credited to the ordinary account in the Consolidated Fund.

5( 3) This section does not apply to any money in the Climate Change Fund the expenditure of which has been authorized by the Legislature before the commencement of this Act.

Commencement

6 This Act comes into force on March 31, 2019.
