An Act to Amend the Prescription and Catastrophic Drug Insurance Act
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Section 8 of the Prescription and Catastrophic Drug Insurance Act, chapter 4 of the Acts of New Brunswick, 2014, is amended
aby adding after subsection (1) the following:
8( 1.1) The Minister may enter into an agreement with a participating provider and the agreement may provide for
athe amount to be paid by the Minister to the participating provider for an entitled service so provided;
bthe amount of a dispensing fee that can be charged by the participating provider for providing professional services in the dispensing of entitled services, subject to any maximum dispensing negotiated pursuant to a regulation enacted pursuant to this Act;
cthe payment by the Minister for all or any part of the dispensing fee being charged by a participating provider for an entitled service, subject to any maximum dispensing negotiated pursuant to a regulation enacted pursuant to this Act;
dthe participating provider to provide such information to the Minister as the Minister may require for the purpose of the agreement;
eany other matter agreed upon between the parties to the agreement; and
fthe amount to be paid by the Minister for professional services provided by pharmacies that are beyond those related to the dispensing fee.
bby adding after subsection (2) the following:
8( 3) The New Brunswick Pharmacists’ Association is hereby constituted the sole bargaining agent on behalf of pharmacists in all discussions under section 29 with respect to fees for services rendered by pharmacists in relation to this Act or its regulation.
