An Act to Amend the Civil Service Act
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 The heading “SERVICE NEW BRUNSWICK” preceding section 3.2 of the Civil Service Act, chapter C-5.1 of the Acts of New Brunswick, 1984, is repealed.
2 The heading “Powers and duties of Service New Brunswick” preceding section 3.2 of the Act is repealed.
3 Section 3.2 of the Act is repealed.
4 The heading “Agreements or arrangements to provide services” preceding section 3.3 of the Act is repealed.
5 Section 3.3 of the Act is repealed.
6 Section 4 of the Act is amended
aby repealing paragraph (d.1);
bby repealing paragraph (e) and substituting the following: 
emay revise or rescind and reinstate any delegation made under paragraph (c) or (d); and
7 Subsection 4.1(1) of the Act is repealed and the following is substituted:
4.1( 1) If the Secretary to Treasury Board has delegated any of his or her powers or duties under this Act to a deputy head, the Secretary to Treasury Board shall ensure that the deputy head, and any delegate of the deputy head, is exercising those powers and duties in the manner required and in accordance with the terms and conditions of the delegation and the requirements of this Act.
8 Section 17 of the Act is amended by adding the following after subsection (8): 
17( 9) An exemption under subsection (4) or an exclusion from the application of this section referred to in a regulation under section 28 shall not have the effect of giving a temporary or casual employee permanent employment.
9 Section 34 of the Act is repealed and the following is substituted: 
34 Deputy heads and employees shall give the Ombud access to their respective offices and facilities and provide assistance and information as the Ombud may require for the performance of the Ombud’s duties under this Act.

10 Subsection 35(2.1) of the Service New Brunswick Act, chapter 44 of the Acts of New Brunswick, 2015, is repealed.
