An Act to Amend the Elections Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 The Elections Act, chapter E-3 of the Revised Statutes, 1973, is amended by repealing subsection 15(1) and substituting the following:

15( 1) Where a vacancy in the Legislative Assembly is certified to the Speaker of the Legislative Assembly or the Clerk of the Legislative Assembly as provided by section 27 of the Legislative Assembly Act, the Lieutenant-Governor in Council shall fix

athe date of the writ, which shall not be more than six months from the date the seat becomes vacant; and

bthe date of the ordinary polling day, which shall be a Monday not more than 38 nor less than 28 days from the date of the writ.
