An Act to Amend the Crown Lands and Forests Act
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Section 1 of the Crown Lands and Forests Act, chapter C‑38.1 of the Acts of New Brunswick, 1980, is amended
aby repealing the definition “proportional supply” and substituting the following:
“proportional supply” means thirty per cent of industrial consumption of wood volumes in the Province; (approvisionnement proportionnel)
bby adding the following definitions in alphabetical order:
“herbicide” means a chemical agent or other product or substance registered under the Pest Control Products Act (Canada) that is manufactured, represented or used as a means for destroying, preventing, controlling or mitigating weeds or other plant life; (herbicide)
“sustained yield” means a maximum of eighty per cent of the private woodlot annual allowable cut as determined by the Minister; (rendement continu)
2 Section 29 of the Act is amended
ain subparagraph (5)(b)(i) by striking out “private woodlots or Producer Associations” and substituting “Forest Products Marketing Boards”;
bby repealing subsection (7.1) and substituting the following:
29( 7.1) The Minister, during the process of approving an operating plan under subsection (7), shall ensure that private woodlots are a source of wood supply consistent with
aproportional supply, and
bsustained yield.
cin subsection (7.2) by striking out “Minister may” and substituting “Minister shall”.
3 The Act is amended by adding after section 76 the following:
HERBICIDES
Offence and penalty
76.1( 1) No person shall aerially spray a herbicide on Crown Lands.
76.1( 2) A person who violates or fails to comply with subsection (1) commits an offence punishable under Part II of the Provincial Offences Procedure Act as a category J offence.
4 This Act comes into force on July 1, 2020.
