An Act to Amend the Tobacco and Electronic Cigarette Sales Act
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Section 1 of the Tobacco and Electronic Cigarette Sales Act, chapter T-6.1 of the Acts of New Brunswick, 1993, is amended by adding the following definition in alphabetical order:
“e-liquid” means liquid used in an electronic cigarette that has a characterizing scent or flavour, other than tobacco, that is noticeable before or during use, or both; (liquide à vapoter)
2 The heading “Sale of flavoured tobacco prohibited” preceding section 2.1 of the Act is repealed and the following is substituted:
Sale of flavoured tobacco, electronic cigarettes or e-liquid prohibited
3 Section 2.1 of the Act is repealed and the following is substituted:
2.1 Despite any other provision of this Act, no person shall sell or permit to be sold any of the following that is represented as being flavoured, that is presented by its packaging, by advertisement or otherwise as being flavoured, or that contains a flavouring agent, including menthol:
atobacco;
belectronic cigarettes; or
