An Act to Amend the Climate Change Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 Section 7.1 of the Climate Change Act, chapter 11 of the Acts of New Brunswick, 2018, is amended

ain subsection (2) in the portion preceding paragraph (a) by striking out “September 1” and substituting “December 1”;

bby adding after subsection (2) the following:

7.1( 3) Despite subsections (1) and (2), an industrial facility that has been designated as a covered facility under subsection 172(1) of the Greenhouse Gas Pollution Pricing Act (Canada) and whose designation is in effect on the commencement of this subsection shall be deemed to have been designated as an opted-in facility under this section on January 1, 2019.

2 Paragraph 10(1)c.61) of the French version of the Act is amended

( i) in subparagraph (ii) by striking out “remis” and substituting “délivré”;

( ii) in subparagraph (iv) by striking out “de l’omission” and substituting “du défaut de se conformer”.

3 Paragraph 1(a) of this Act comes into force or shall be deemed to have come into force on December 1, 2020.
