An Act to Amend the Combat Sport Act
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Subsection 2(1) of the Combat Sport Act, chapter 48 of the Acts of New Brunswick, 2014, is amended
ain paragraph (d) of the English version by striking out “and” at the end of the paragraph;
bin paragraph (e) by striking out the period at the end of the paragraph and substituting “; and”;
cby adding after paragraph (e) the following: 
fBrazilian jiu-jitsu.
2 Paragraph 5(1)(d) of the Act is amended by striking out “under this Act” and substituting “under this Act or the regulations”.
3 Subsection 20(2) of the Act is repealed and the following is substituted: 
20( 2) An application for an event permit that contains the information prescribed by regulation shall be accompanied by
athe documents prescribed by regulation,
bthe fee for an event permit in an amount prescribed by regulation, and
ca bond or other security, in an amount determined by the Commission that is not less than the minimum amount and not more than the maximum amount fixed by regulation, in the form established by the Commission.
4 Subsection 23(2) of the Act is repealed and the following is substituted: 
23( 2) The holder of an event permit shall comply with the provisions of this Act and the regulations and with the terms and conditions of the event permit, and shall provide to the Commission any document, information, fee, security or any other amount prescribed by regulation within the time prescribed by regulation.
5 The Act is amended by adding after section 26 the following: 
Bond or other security
26.1 The Commission may withhold all or a portion of the bond or other security required under subsection 20(2) at the time and in the circumstances prescribed by regulation.
6 Subsection 39(2) of the Act is repealed and the following is substituted: 
39( 2) An inspector may order an event to be stopped or suspended if the inspector is satisfied that there has been a contravention of the Act or the regulations, the rules of the combat sport for which the event is held, the conditions of the event permit or the code of conduct established by the Commission.
7 Subsection 44(1) of the Act is amended
aby adding after paragraph (b) the following: 
b.1prescribing the minimum and maximum amounts of a bond or other security payable by an applicant for an event permit;
bby adding after paragraph (n) the following: 
n.1requiring the holder of an event permit to deposit in trust to the Commission, in the prescribed form, the full amount of the purses payable to contestants participating in an event, and the time limit for the deposit;
n.2requiring the holder of an event permit to deposit in trust with the Commission the full amount of fees payable to officials designated to attend at an event, including those payable to ringside medical practitioners, and the time limit for the deposit;
cin paragraph (t) by striking out “a promoter” and substituting “the Commission”;
din paragraph (v) by striking out “a promoter” and substituting “the Commission”;
eby adding after paragraph (w) the following: 
w.1prescribing the duties and powers of the Commission in relation to and at an event;
fin subparagraph (bb)(iii) by striking out the period at the end of the subparagraph and substituting a semicolon;
gby adding after paragraph (bb) the following: 
ccprescribing the time and circumstances for the purposes of section 26.1.
CONSEQUENTIAL AMENDMENTS
Regulation under the Combat Sport Act
8 The heading “Prescribed combat sports” preceding section 2.1 of New Brunswick Regulation 2014-131 under the Combat Sport Act is repealed.
9 Section 2.1 of the Regulation is repealed.
10 Subsection 3(5) of the French version of the Regulation is amended by striking out “des règles de combat du sport” and substituting “des règles du sport de combat”.
11 Section 5 of the Regulation is repealed and the following is substituted: 
5( 1) At least 30 days before the date of the event, the holder of an event permit shall provide the Commission with the following documents and information:
athe contestants matched up to participate in each bout to be held, including:
( i) the name of both contestants;
( ii) the weight class of both contestants, determined in accordance with the rules of the combat sport supplied to the Commission under subsection 3(5);
bthe number of bouts to be held;
cthe number of rounds in each bout;
dthe amount of the purse, if any;
ean emergency plan for the venue where the event will be held; and
fa security plan that meets the following requirements:
( i) security services for the event shall be provided by a person who holds a security services licence issued under the Private Investigators and Security Services Act; and
( ii) the event shall be staffed by one security guard for every 100 persons expected to attend the event.
5( 2) At least 30 days before the date of an event, the Commission shall provide the holder of an event permit with the following information: 
athe names of the following designated officials that the Commission is required to have present at an event:
( i) the referees;
( ii) the judges;
( iii) the timekeepers; and
( iv) the room supervisors;
bthe names of the ringside medical practitioners that the Commission is required to have present at an event, and
cthe amount of the fee fixed by the Commission for each official and ringside medical practitioner that is to be paid by the holder of the event permit.
12 Section 7 of the Regulation is amended by adding after subsection (2) the following: 
7( 3) At least 14 days before the date of the event, the holder of an event permit shall deposit in trust with the Commission a money order or certified cheque in the agreed amount payable to each contestant as the purse for participating in the event.
7( 4) At least 14 days before the date of the event, the holder of an event permit shall deposit in trust with the Commission funds equal to the full amount payable as fees to officials, including the ringside medical practitioners, that the Commission is required to have present at an event.
13 Section 9 of the Regulation is amended
aby repealing subsection (2) and substituting the following: 
9( 2) Within 14 days after an event is held, the holder of the event permit shall provide or pay to the Commission, as the case may be,
aa report on the ticket sales for the event, and
bthe full amount of fees referred to in subsection 21(2) of the Act.
bby adding after subsection (3) the following: 
9( 4) Within 14 days after the date set for an event, the Commission may withhold all or a portion of the bond or other security required under subsection 20(2) of the Act if
athe event was held and the holder of the event permit failed to comply with the requirements of the Act and the regulations, or
bthe holder of the event permit failed to hold the event.
9( 5) Within 14 days after the date set for the event, the Commission shall return to the holder of the event permit the full amount of the bond or other security required under subsection 20(2) of the Act if
athe event was held and the holder of the event permit complied with the requirements of the Act and the regulations, or
bthe holder of the event permit was unable to hold the event, through no fault of their own.
14 The heading “Persons required to be present at an event” preceding subsection 13 of the Regulation is repealed and the following is substituted:

15 Section 13 of the Regulation is amended
ain subsection (1) in the portion preceding paragraph (a) by striking out “The promoter” and substituting “The Commission”;
bin subsection (2) by striking out “The promoter” and substituting “The Commission”;
cby repealing subsection (3) and substituting the following: 
13( 3) If any official required to be present under subsection (1) or (2) is unable to be present at an event, the Commission shall provide a replacement who holds a licence of the same category as the official being replaced and, if there is no replacement available, the Commission shall cancel the event.
dby repealing subsection (4) and substituting the following: 
13( 4) At the end of an event, the Commission shall remit to each contestant the agreed amount of the purse that is held in trust under subsection 7(3).
eby repealing subsection (5) and substituting the following: 
13( 5) At the end of an event, the Commission shall distribute to each official and ringside practitioner the agreed amount of the fee that is held in trust under subsection 7(4).
16 Section 15 of the Regulation is amended
ain paragraph (1)a) of the French version by striking out “les règles de combat du sport” and substituting “les règles du sport de combat”;
bby repealing subsection (2).
17 Subsection 16(4) of the French version of the Regulation is amended in the portion preceding paragraph a) by striking out “les règles de combat du sport” and substituting “les règles du sport de combat”.
18 Subsection 22(2) of the French version of the Regulation is amended by striking out “les règles de combat” and substituting “les règles du sport de combat”.
19 Section 24 of the Regulation is amended
aby adding before subsection (1) the following: 
24( 0.1) An inspector shall be present at all combat sport events.
bby adding after subsection (2) the following: 
24( 3) If a ringside medical practitioner ceases to be present at an event, the inspector shall suspend all bouts in the event until two ringside medical practitioners are present.
20 The heading “Event permit application fee” preceding section 27 of the Regulation is repealed and the following is substituted: 
Permit fees and security
21 The Regulation is amended by repealing section 27 and substituting the following: 
27 For the purposes of subsection 20(2) of the Act,
athe application fee for an event permit is $100 and is non-refundable, and
bthe amount of the bond or other security accompanying an application for an event permit shall be a minimum of $500 and a maximum of $3,000.
