Miscellaneous Statutes Amendment Act
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
An Act Respecting Animal Protection
1 Subsection 2(14) of An Act Respecting Animal Protection, chapter 16 of the Acts of New Brunswick, 2017, is repealed and the following is substituted:
2( 14) The Act is amended by adding after section 23 the following:
Offence re sale of animal without a certificate of health
23.1( 1) No person shall sell or offer to sell to a purchaser any animal prescribed by regulation for which a certificate of health has not been issued by a veterinarian, in the form prescribed by the regulations, whether or not the purchaser has waived the requirement for a certificate.
23.1( 2) A person who violates or fails to comply with subsection (1) commits an offence punishable under Part 2 of the Provincial Offences Procedure Act as a category C offence.
Offence re contests involving fighting between animals
23.2( 1) No person shall in any manner conduct, promote or participate in a contest involving fighting between animals and all contests involving fighting between animals are prohibited.
23.2( 2) A person who violates or fails to comply with subsection (1) commits an offence punishable under Part 2 of the Provincial Offences Procedure Act as a category J offence.
Offence re tethering a dog outdoors
23.3( 1) A person who has ownership, possession or care and control of a dog shall not tether the dog outdoors, except in accordance with the standards prescribed by regulation.
23.3( 2) A person who violates or fails to comply with subsection (1) commits an offence punishable under Part 2 of the Provincial Offences Procedure Act as a category E offence.
Days of Rest Act
2 Section 1 of the English version of the Days of Rest Act, chapter D-4.2 of the Acts of New Brunswick, 1985, is amended in the definition “licensed pharmacist” by striking out “New Brunswick Pharmaceutical Society” and substituting “New Brunswick College of Pharmacists”.
Midwifery Act
3 Paragraph 5(d) of the English version of the Midwifery Act, chapter M-11.5 of the Acts of New Brunswick, 2008, is amended by striking out “New Brunswick Pharmaceutical Society” and substituting “New Brunswick College of Pharmacists”.
Regulation under the Midwifery Act
4 Section 9 of the English version of New Brunswick Regulation 2010-113 under the Midwifery Act is amended
ain paragraph (1)(d) by striking out “New Brunswick Pharmaceutical Society” and substituting “New Brunswick College of Pharmacists”;
bin subsection (7) by striking out “New Brunswick Pharmaceutical Society” and substituting “New Brunswick College of Pharmacists”.
Regulation under the Prescription Drug Payment Act
5 Section 29 of the French version of New Brunswick Regulation 84-170 under the Prescription Drug Payment Act is amended
ain subsection (1) by striking out “Ordre” wherever it appears and substituting “Association”;
bin subsection (2) by striking out “Ordre” and substituting “Association”;
cin subsection (3)
( i) in the portion preceding paragraph a) by striking out “Ordre” and substituting “Association”;
( ii) in paragraph b) by striking out “Ordre” and substituting “Association”;
din subsection (4) by striking out “Ordre” and substituting “Association”.
Prescription Monitoring Act
6 Section 1 of the Prescription Monitoring Act, chapter P-15.05 of the Acts of New Brunswick, 2009, is amended
ain the definition “licensed pharmacist” by striking out “New Brunswick Pharmaceutical Society” and substituting “New Brunswick College of Pharmacists”;
bin paragraph (c) of the definition “licensing authority” by striking out “New Brunswick Pharmaceutical Society” and substituting “New Brunswick College of Pharmacists”.
Repeal of Sheep Protection Act
7 The Sheep Protection Act, chapter 130 of the Revised Statutes, 2014, is repealed.
