An Act to Amend the Building Code Administration Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 Section 1 of the Building Code Administration Act, chapter 8 of the Acts of New Brunswick, 2020, is amended by repealing the definition “court” and substituting the following: 

“court” means the Provincial Court of New Brunswick, and includes any judge of that court. (cour)

2 Section 23 of the Act is amended

ain subsection (1) by striking out “for a period of 12 months after the commencement of this section” and substituting “until December 31, 2022”;

bin subsection (2) by striking out “within 12 months after the commencement of this section” and substituting “on or after January 1, 2023”.

3 Paragraph 24(a) of the Act is repealed and the following is substituted: 

(a)  was commenced within 23 months of the date the permit was issued, and

4 Section 5 of New Brunswick Regulation 2021-2 under the Building Code Administration Act is amended

aby repealing paragraph (a) and substituting the following: 

aan accessory building with a total floor area that is not greater than 55 m² and that is not intended for overnight accommodation;

bin paragraph (c) by striking out “56.08 m²” and substituting “58.06 m²”.

Commencement

5 Section 4 of this Act comes into force on January 1, 2023.
